Acceptance of Terms

By accessing or using VidsGenius, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use our Service.

Description of Service

VidsGenius is a video analytics platform that provides insights and analysis of YouTube channel and video performance using publicly available data.

YouTube API Services

Our Service uses YouTube API Services. By using our Service, you agree to be bound by the YouTube Terms of Service.

YouTube Data Usage

  • We access only publicly available YouTube data
  • You provide channel URLs for analysis
  • All analyzed data is already publicly visible on YouTube
  • No personal YouTube account access required

User Accounts

Account Requirements

  • You must provide accurate information
  • You must be at least 13 years old
  • You are responsible for account security
  • One account per user unless authorized

Account Security

  • Keep your login credentials secure
  • Notify us of any unauthorized access
  • You are responsible for all account activities

Acceptable Use

You may:

  • Analyze YouTube channels and videos
  • Generate reports and insights
  • Export data for your business purposes

You may not:

  • Use the Service for illegal purposes
  • Violate YouTube's Terms of Service
  • Attempt to hack or reverse engineer our Service
  • Share your account credentials
  • Use the Service to harm others

Subscriptions and Billing

Current pricing, plans, and billing terms are available on our Pricing page, which forms part of these Terms.

Key billing terms:

  • Subscriptions renew automatically
  • You can cancel anytime through your account
  • Cancellation takes effect at the end of your billing period

Refund Policy

We are committed to providing a fair and transparent refund process:

  • No refund for credits already used: Credits that have been used for completed analyses are not eligible for a refund, regardless of your satisfaction with the results.
  • Automatic refund for failed analyses: If an analysis fails to complete due to a technical issue on our end, the credits used for that analysis will be automatically refunded to your account. No action is required on your part.

Refunds are not provided for dissatisfaction with analysis results, as all analyses are generated by artificial intelligence and results are subjective. If you believe a technical error has occurred, please contact support for review.

Intellectual Property

Our Rights

  • We own the Service software and platform
  • Our trademarks and content are protected
  • You may not copy or distribute our software

Your Rights

  • You retain ownership of your YouTube content
  • You own your original analysis and reports
  • We do not claim ownership of your data

Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.

Service Availability

  • We aim for high uptime but cannot guarantee uninterrupted service
  • We may perform maintenance that temporarily affects availability
  • Service may be limited by third-party APIs (YouTube, etc.)

A/B Testing & Experimentation

You acknowledge the Service may present different interface variants, feature arrangements, or flows to different users or sessions for the purpose of measurement, usability, reliability, or performance optimization. Such experimentation does not grant any expectation of continued availability of a specific variant or feature. We may discontinue or replace variants at any time.

Disclaimers and Limitations

Service "As Is"

  • The Service is provided "as is" without warranties of any kind, express or implied
  • We do not guarantee the accuracy, completeness, or reliability of any data, analysis, or results
  • All analyses and reports are generated by artificial intelligence and may contain errors, omissions, or misinterpretations
  • You should not rely solely on our results for any business, legal, or personal decisions
  • Your use of the Service is at your own risk
  • AI output is NOT professional advice (legal, financial, medical, investment, or otherwise)

Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability to you for any claim will not exceed the amount you paid for the Service in the thirty (30) days preceding the event giving rise to the claim
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, loss of goodwill, or business interruption, even if we have been advised of the possibility of such damages
  • We are not liable for any claims, damages, or losses arising from dissatisfaction with the results of the Service, errors or omissions in the analyses, or any actions taken in reliance on the information provided

Indemnification

You agree to indemnify and hold harmless VidsGenius, its owner, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another.

Termination

By You

  • Cancel your subscription anytime
  • Request account deletion
  • Cancellation takes effect at billing period end

By Us

  • We may terminate accounts that violate these Terms
  • We may discontinue the Service with reasonable notice
  • We may suspend service for non-payment

Changes to Terms

We may update these Terms periodically. Significant changes will be communicated via email or Service notification. Continued use after changes constitutes acceptance.

Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to contact us at admin@vidsgenius.com to attempt to resolve the issue informally.

Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. Arbitration will be conducted under the rules of the American Arbitration Association.

Class Action Waiver

You agree that disputes will be resolved on an individual basis and waive any right to participate in class actions or collective arbitrations.

General Provisions

Governing Law

These Terms are governed by New York law without regard to conflict of law principles.

Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, power failures, third-party platform outages, strikes, acts of government, network disruptions, or upstream API changes.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

Entire Agreement

These Terms, together with our Privacy Policy and Pricing page, constitute the entire agreement between you and VidsGenius.

Survival

The following sections survive termination: Intellectual Property, Refund Policy (for accrued obligations), Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.

No Affiliation

VidsGenius is not affiliated with YouTube or Google.
